This agreement regulates the general conditions for booking, purchasing or hiring the various products and services offered on this website by HNHC PRODUCCIONES, SL (hereinafter KANAKA) with CIF no. B-93566024.

The CLIENT, at the time of completing the registration process and contracting any of our services, expressly accepts and submits to the clauses specified below, as well as to the General Terms of Use of our website and its Privacy Policy.

The CLIENT acknowledges having sufficient legal capacity to contractually obligate themselves and only individuals over 18 years of age or companies may contract KANAKA’s services.

This contract is permanently accessible in the footer of our website and can be downloaded at the time of contracting.

Prices and taxesIn exchange for the service acquired, the CLIENT expressly agrees to pay KANAKA the amounts specified at the time of contracting. Anything that is not specified in the description as included is not included.

The accommodations offered on this website are not subject to Value Added Tax (VAT); events are subject to a 21% VAT, NOT INCLUDED in the prices listed for each of them.

Contracting procedure

All our prices and services are individually detailed on the website.

Procedure for booking accommodations:

  1. Carefully read the service description and its contracting conditions.
  2. Check availability and select the dates for your accommodation.
  3. Indicate the number of guests. Enter the coupon code if you have one.
  4. Process the payment following the steps indicated by the payment gateway.

7 days before arrival:

  1. Sign the Temporary Rental Agreement with the specific conditions and rules of the contracted property.
  2. Deposit the corresponding security deposit.
  3. Register the guests with the local Authorities.
  4. Pay for any desired extras.
  5. Once the above is completed, you will receive another email with the virtual access keys to the property.

Procedure for booking events:

  1. Read carefully the service description and its contracting conditions.
  2. Check availability of the event dates.
  3. Contact KANAKA requesting approval of the event and confirmation of the price.
  4. If approved, make the reservation by paying the amount through the means indicated by KANAKA.

7 days before arrival:

  1. Sign the Temporary Rental Contract with the specific conditions and rules of the contracted property.
  2. Deposit the corresponding security deposit.
  3. Register guests for local Authorities if it is an accommodation.
  4. Pay for any desired extras.
  5. Once the above has been done, you will receive another email with the virtual keys to access the property.

The CLIENT is informed that the photographs and descriptions of the products and services on the website are merely informative and approximate and may differ from the original or may not be up-to-date.

Payment Methods

All of our payment systems are completely secure and KANAKA will not have knowledge of or retain your payment information such as your card, bank account, or similar. The following payment methods are accepted:

  1. Credit Card: The transaction is carried out by connecting directly with Stripe through its payment gateway.
  2. Stripe: The transaction is carried out by connecting directly with Stripe through its payment gateway.
  3. Bank Transfer: By making a deposit of the total amount of the purchase into the current account indicated by KANAKA.
  4. Crypto: BTC and USDC are accepted as a means of payment by transferring to the wallet indicated by KANAKA.

Once payment has been made, you will receive an email confirming the payment.

KANAKA will not provide the requested service until payment has been received in full. KANAKA reserves the right to temporarily or definitively cancel the services provided in the event of any incident related to payment or detection of any attempt at fraud.

Invoices

If you need an invoice, please request it at info@kanaka.es.

The CLIENT is responsible for confirming receipt of notifications and for notifying us of any changes to their information, with KANAKA being released from any responsibility arising from this circumstance.

Guarantee

All of our properties are subject to strict quality controls. However, if any element or service of the property is essential to you, please verify its existence with KANAKA before contracting the service.

On the other hand, if you arrive and find that something is missing or not in good condition or not working, please notify KANAKA within 24 hours so that we can find a solution.

Cancellation

In the event of a cancellation, payments made for the reservation of the property are 100% refundable up to 60 days before arrival and 50% refundable up to 30 days before arrival. After this period, no refunds will be made.

Cancellations will be managed through sending an email to info@kanaka.es providing a description of the reasons and causes alleged for the cancellation. Likewise, it will be necessary to indicate the name, surname, and reference number of the reservation. Once the request is received, it will be processed promptly.

Perfection of the contract and modifications of services

This contract will be perfected with the payment of the service and the sending of a confirmation email to the CLIENT with a description of the purchase made. KANAKA reserves the right to modify the characteristics and conditions of its services in any way, always with the aim of improving them and benefiting the CLIENT.

Obligations of the parties

KANAKA undertakes to provide the CLIENT with the products and services that have been contracted, applying the maximum diligence in the provision of the service, as well as taking care of the maintenance of the necessary facilities for their proper functioning.

The CLIENT agrees to use the property and all elements made available to them in good faith, without violating the laws in force in any matter or infringing the rights of third parties.

KANAKA does not guarantee that the availability of the service object of this contract will be continuous and uninterrupted, due to circumstances arising from problems on the Internet network, breakdowns in computer devices, installations, supplies, and other unforeseeable circumstances. Therefore, the CLIENT accepts to bear within reasonable limits these circumstances, expressly waiving any contractual or extra-contractual liability claims against KANAKA for possible failures, errors, and use of the contracted service.

Communications

In compliance with Article 21 of Law 34/2002 on Information Society Services and Electronic Commerce, we inform you that our commercial communications and information related to our website and the products offered therein will be sent by email to the email address you provide, always with the possibility of revocation. In any case, you have the option to reject our commercial communications by sending an email to the address info@kanaka.es indicating the word “BAJA” in the subject.

Commitment, validity and acceptance of the contract

The CLIENT acknowledges having read and accepted the General Conditions of Use and the Privacy Policy of the website.

The CLIENT acknowledges that he/she has understood all the information regarding the products and services offered on our website, as well as all the conditions and stipulations contained in this electronic contract, and therefore affirms that they are sufficient for the exclusion of error in the consent of this contract, and therefore accepts them in full and expressly.

The CLIENT is fully aware that the acceptance and execution of this contract will take place by providing their data and pressing the “Proceed to payment” button indicated on our website and will be perfected with the payment of the service.

Applicable regulations

This contract has a commercial nature and will be governed and interpreted in accordance with Spanish laws.

In the event of any discrepancy or difference between the parties regarding the interpretation, content or execution of the Contract that is not resolved by mutual agreement, the Parties shall submit to the courts or tribunals that are competent in each case, provided that the user is a consumer.

In cases where the parties may submit to a jurisdiction, they shall submit to the Courts and Tribunals of the city of Fuengirola (Spain), with express waiver of any other jurisdiction that may correspond to them.
